Terms of Service

These Terms are an agreement between you and Theophilus Ventures, LLC(doing business as TapeSave) — in these terms, “TapeSave,” “we,” and “us” mean Theophilus Ventures, LLC. By using TapeSave, you agree to these Terms of Service, our Privacy Policy, and our Refund Policy. If you do not agree to these terms, please do not use the service. You must be at least 18 years old to purchase credits or use TapeSave.

TapeSave is a video processing service. You upload a digitized video file (typically from a VHS tape), and we split it into individual clips, recover the original recording dates when possible, and generate descriptions. You then download the organized clips.

TapeSave uses a credit-based system. One credit = one video file, regardless of length. Whether your tape is 30 minutes or 5 hours, it's one credit. Credits are purchased in advance through our website. Every purchase is one-time — TapeSave has no subscriptions, and nothing you buy auto-renews or bills you again.

At checkout you can add one-time extras to an order:

• Restore & Enhance — a picture clean-up pass applied to each video in the order (smooths tape grain and noise, sharpens detail, revives faded color). It improves degraded analog footage; it does not convert old recordings to HD.
• USB keepsake— once your clips are ready, we load them on a USB drive and mail it to the U.S. address you provide at checkout. If the drive arrives damaged or defective, we'll replace it free. Because it's a custom-loaded physical item, the USB add-on is refundable before it ships; after it ships we replace (rather than refund) defective drives.
• White-Glove— a one-time bundle: up to 15 videos with Restore & Enhance on each, a hand-checked highlight reel, the USB keepsake, and priority processing.
• Gift cards — a one-time code good for a set number of videos. Codes never expire and carry no fees. The 14-day money-back guarantee applies while a code is unredeemed.

We stand behind our work. If you're not satisfied with the results, email us at [email protected] and we'll reprocess your video at no additional charge. If reprocessing doesn't resolve the issue, we'll refund the credit. Refund requests must be made within 14 days of purchase.

Unused credits can be refunded within 90 days of purchase. Credits never expire. For full details, see our Refund Policy.

You own everything you upload and everything we produce from it. We don't claim any rights to your videos, clips, descriptions, or any other content. Your family memories are yours. You represent that you have the right to upload any content you submit to TapeSave.

All uploaded files and processed clips are scheduled for deletion 30 days after your clips are delivered — or 30 days after the last time a clip is shared, whichever is later. Ask us and we will delete sooner. We recommend downloading your clips as soon as they're ready. After deletion, we cannot recover your files.

Please use TapeSave for its intended purpose: organizing your personal home videos. Don't upload content you don't have the rights to, and don't use the service for anything illegal. We reserve the right to refuse service or terminate access for violations of these terms.

You agree to indemnify and hold harmless TapeSave and its operators from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the service, including any content you upload or any violation of these Terms.

TapeSave is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do our best to keep the service running smoothly, but we cannot guarantee 100% uptime or error-free operation. We may update or change the service from time to time.

To the maximum extent permitted by applicable law, TapeSave shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damage to personal property, arising from your use of the service. Our total liability shall not exceed the amount you paid to TapeSave in the twelve (12) months preceding the claim.

We strongly recommend keeping your original digitized files as a backup. TapeSave processes copies of your files — always retain your originals.

These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles. Subject to the arbitration section below, any disputes arising from these Terms or your use of TapeSave shall be resolved in the state or federal courts located in Louisiana, and you agree to submit to the personal jurisdiction of these courts.

We'd always rather fix a problem directly — email [email protected] first and we'll genuinely try to make it right. Before starting any formal proceeding, you agree to contact us and give us 30 days to resolve the issue.

If we can't resolve it, you and TapeSave agree that any dispute will be settled by binding individual arbitration rather than in court, except qualifying small-claims cases, which either of us may still bring. To the extent allowed by law, disputes will be handled only on an individual basis — not as a class, collective, or representative action.

Your 30-day right to opt out: you can opt out of this arbitration agreement within 30 days of first accepting these terms by emailing [email protected] with the subject “Arbitration opt-out.” Opting out doesn't affect anything else in these terms. Some claims, states, and countries limit arbitration and class-action waivers; nothing here waives a right you cannot legally waive.

We want TapeSave to work for everyone, including people who use assistive technology, and we aim to meet recognized web accessibility guidelines (WCAG 2.1 AA). If anything is hard to use, email [email protected] and we'll help directly and fix it.

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. Your continued use of TapeSave after any changes constitutes acceptance of the updated Terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and TapeSave regarding your use of the service.
